The Case Against Judge Brett Kavanaugh

Editor’s Note: This article appears in the current issue (Sept. 2018) of Catholic Family News (click HERE to subscribe; current subscribers can access the E-Edition HERE). With Senate Judiciary Committee hearings beginning today (Sept. 4, 2018) for Judge Brett Kavanaugh, this article offers a timely treatment of President Trump’s nominee to the U.S. Supreme Court.

Nazis who claimed to be following orders in carrying out the holocaust were hanged at Nuremberg. Judge Brett Kavanaugh says upholding the pro-abortion Roe v. Wade decision is following “precedent.” While some might say that a comparison between the Nazi extermination campaign and abortion-on-demand is harsh, the fact is that Roe v. Wade violated the God-given right to life and has led to 60 million abortions in the U.S. Overall, since the Russian communist revolution legalized abortion, there have been 1 billion abortions, making this holocaust the greatest genocide ever.

What’s more, Kavanaugh’s mentor on the Supreme Court, Anthony Kennedy, followed precedent (as Kavanaugh promises to do) and upheld Roe V. Wade in the case of Planned Parenthood v. Casey.

While Kavanaugh enjoys the reputation of being a constitutional conservative, the evidence shows that President Trump has been tricked by his legal advisers, especially White House Counsel Don McGahn, into picking someone for the Supreme Court whose positions and writings on important legal and moral issues promise more human carnage and subversion of our traditional values. My report, The Deep State Wears Black Robes, explains in detail how the Kavanaugh nomination came about, and why Kavanaugh’s ascension to the Supreme Court even puts the rights of Christians to practice their faith in jeopardy. (My report notes that McGahn, who threatened to resign if President Trump fired Russia-gate Special Counsel Robert Mueller, has been cooperating with Mueller, setting up a possible constitutional confrontation that could reach the Supreme Court.)

Kavanaugh was a law clerk for Kennedy, a professing Catholic who not only found a right to abortion in the Constitution, but imposed unnatural “gay marriage” on the fifty states.

Kavanaugh, who also professes to be a Catholic, insists that Kennedy’s legacy was one of “securing liberty.” Phillip L. Jauregui of the Judicial Action Group countered, “In fact, Kennedy devoted his career to the opposite: perverting liberty and it cost a generation of unborn children their lives!”

Catholics dominate the Supreme Court, but several of them, led by Kennedy, made a mockery of the Constitution and the Catholic Faith. These Catholics disregarded the teachings of their faith about human life and marriage which were entirely consistent with the Constitution and actually expressed the intentions of our nation’s founders.

On top of the sexual abuse scandals, the Roman Catholic Church has to come to grips with this scandal within its ranks and begin excommunicating “Catholics” like Kennedy who abandoned America’s Christian heritage and betrayed America from the bench.

The rulings on abortion and “gay marriage” have followed dictates to eliminate the Bible and Christianity – and even the right to pray – from public forums. The criminalization of Christianity is the next battle, and it’s far from clear that Kavanaugh can be counted on to fight for the rights of believers. The Catholic Standard noted that in one ruling, Kavanaugh said the government “has a compelling interest in facilitating access to contraception” for the employees of religious organizations.

Sounding like a liberal social justice warrior, Kavanaugh has openly spoken of taking care of “the poor, the neglected, and the vulnerable,” but he has never, to my knowledge, declared any sympathy for the plight of the innocent unborn. Indeed, in a case of an illegal alien seeking an abortion, he disputed that immigrant minors had a right to “immediate abortion on demand” and urged the government to transfer her to private custody so she could do “as she wished.”

A Liberal Parish

Kavanaugh is a member of the Shrine of the Most Blessed Sacrament in Washington, D.C., a parish that includes prominent Democrats from the nation’s capital such as the late Senator Ted Kennedy, who voted for abortion on demand but claimed to be personally opposed. A search of the church’s website reveals one condemnation of abortion from a sermon delivered back in 2008.

Blessed Sacrament had an ongoing Abrahamic Faiths Project, which in 2008 featured then-Cardinal Theodore McCarrick, archbishop emeritus of Washington, talking about how Jews, Christians, and Muslims supposedly worship the same God. McCarrick was known to favorably compare Islam to Catholicism and was labeled by critics as “McCarrick the Muslim.”

“Catholic social teaching is based on the dignity of the human person,” McCarrick declared. “As you study the holy Koran, as you study Islam, basically, this is what Muhammad the prophet, peace be upon him, has been teaching.”

Equally significant, he has now been identified as the highest-ranking U.S. Catholic leader ever to be removed for sexually abusing a child and is also accused of sexually abusing seminarians. He was a leading “progressive” in the Church who supported homosexual civil unions, a form of marriage, as far back as 2006.

Catholic columnist Matt Abbott, who reported McCarrick’s homosexual activity back in 2005, told me, “I believe the Church establishment and mainstream media protected him, mainly because he’s a prominent liberal cardinal.”

It would be unfair, of course, to associate Kavanaugh with McCarrick simply because McCarrick appeared under the auspices of his parish and ran the Catholic community in the nation’s capital. By the same token, however, there is no record of Kavanaugh speaking out on the threat to Christianity posed by radical Islam, the sexual scandals within his Church, or the judicial tendency to play down moral teachings and God’s law.

Rather than address such issues in the Church or elsewhere, it appears that Kavanaugh spent his free time coaching his daughters’ basketball teams. That’s a nice family activity but saving all of our families and our nation’s Christian heritage requires cleaning up the corruption in the Church and expelling the homosexual and Marxist infiltrators. Kavanaugh appears to have been AWOL in this battle against heresy.

Advancement Through Elite Connections

Kavanaugh and his wife “have lived on the Maryland side of Chevy Chase, an enclave at the center of establishment Washington, with streets lined with million-dollar homes, most of them inhabited by accomplished Democrats,” noted The Washington Post in an article titled, “The elite world of Brett Kavanaugh”. That elite world would include attending the Red Mass, a Roman Catholic liturgy held annually the Sunday before the Supreme Court’s new term that includes judges, lawyers, law school professors, and government officials.

You can be sure Kavanaugh was rubbing elbows with the elites of the American Catholic Church, including McCarrick and more recently Cardinal Donald Wuerl, the sixth Archbishop of Washington who succeeded McCarrick and is the subject of a Grand Jury report about sexual abuse by Catholic priests in Pennsylvania, where he spent 18 years as the bishop of Pittsburgh. “Priests were raping little boys and girls, and the men of God who were responsible for them not only did nothing; they hid it all,” says the Grand Jury report.

Kavanaugh reportedly got the nod as the nominee because of his extensive Washington connections, in politics, the media, and the Church. Conservative public interest attorney Larry Klayman speculates that the reason he spent an inordinate amount of money – tens of thousands of dollars – on Washington Nationals baseball tickets was to cultivate movers and shakers (members of the Swamp) who could help him advance. The Nationals baseball park is located just south of the Capitol in D.C.

The Gay Mafia

The issue of corruption in the Church could not be avoided, even by Kavanaugh and those who were rubbing elbows with the elite. Indeed, these figures may have known more than most about the scandals. My local priest took note of the McCarrick scandal and warned about the dangers of a “Lavender Mafia” or homosexual cabal in the Church. Randy Engel, author of The Rite of Sodomy: Homosexuality and the Roman Catholic Church, has been researching and writing about this problem since 1986. She was featured on my America’s Survival TV show in 2016. The 2015 Oscar-winning film Spotlight was based on the Boston Globe investigations in 2002 of predator priests and cover-ups in Boston.

What, if anything, did Kavanaugh say or do about these problems? Considering his extensive and elite connections and knowledge and what was happening within the Church, it would seem highly unlikely that he knew nothing about their existence. The father of two children, did he speak up? Did he say anything?

At a time when the Roman Catholic Church in America in various jurisdictions is being exposed as a criminal enterprise that facilitated and covered up the sexual abuse of minors, most of them boys, these are not questions that should be regarded as off-limits for a Catholic nominee to the Supreme Court. It is not anti-Catholic bigotry to demand answers. Catholics must lead the way. Indeed, Catholic groups are leading a protest movement called “Silence Stops Now” demanding that Cardinal Donald Wuerl and others be held accountable. Citing the most recent Pennsylvania Grand Jury report, this coalition says, “The kingpin of the American hierarchy – a man who over the decades has carefully and meticulously cultivated an image of reformer – has now been exposed as a fraud, just as guilty as scores of other bishops in the U.S. who hid and shuffled around homosexual predator priests and concealed them from law enforcement officials.”

Precedent Over Principle

Insisting that he is somehow an “originalist” on the Constitution who will slowly but surely reverse America’s cultural decline, Kavanaugh supporters note that he once gave a lecture praising former Chief Justice William Rehnquist, a dissenter in the notorious Roe v. Wade pro-abortion decision. But Kavanaugh has been far more outspoken about preserving this ruling, repeatedly citing it as “precedent.” That was the Kennedy “just-following-precedent” approach.

“We operate in a system built on Supreme Court precedent,” Kavanaugh said in an essay published by the Catholic University Law Review. In fact, the “system” was built on respect for the Constitution, and his oath, if confirmed, requires fidelity to that Constitution. The Constitution is the “precedent” that matters.

Kavanaugh’s decision to emphasize adherence to pro-abortion “precedent” is an effort to pander to pro-abortion Senators needed for his confirmation. He tried the same trick when he was nominated to the federal bench. In an exchange with pro-abortion Senator Chuck Schumer, Kavanaugh said, “…I would follow Roe v. Wade faithfully and fully. That would be binding precedent of the Court. It’s been decided by the Supreme Court… It’s been reaffirmed many times, including in Planned Parenthood v. Casey.” Asked if Roe v. Wade were an abomination, Kavanaugh added, “…I don’t think it would be appropriate for me to give a personal view of that case.”

He could have declared the murder of 60 million innocent unborn an abomination, which it is, or he could finesse the issue by telling Schumer and the other pro-abortion Senators what they wanted to hear. He did the latter and was confirmed in a 57-36 vote.

There are some conservatives who say that we ought to have faith that if he makes it to the Supreme Court he will decide to overturn Roe. We were also told that Kennedy, who hired Kavanaugh as his law clerk, was another reliable conservative. But he gave us more abortions and “gay marriage.”

Remember that Kennedy was nominated by President Ronald Reagan, a pro-life president. Reagan made another mistake when he nominated Sandra Day O’Connor to the court. She also turned out to be pro-abortion.

There was another Catholic in the running for the Supreme Court nomination who had a much better record than Kavanaugh. Her name was Amy Coney Barrett, a former law clerk to the late Justice Antonin Scalia. Barrett had said that the so-called “right to privacy,” upon which Roe v. Wade and other pro-abortion decisions were based, did not address the fact that abortion “deals with the life of a child…” and could therefore be reversed. She was also critical of Obamacare for threatening the rights of religious people.

During an interview on America’s Survival TV, Ricardo Davis, president of Georgia Right to Life, came out against the Kavanaugh nomination, and urged Trump to withdraw Kavanaugh’s name and replace him with Judge Barrett.

Withdraw the Kavanaugh Nomination

The hard evidence shows that Kavanaugh has in fact been a member in good standing of the Swamp. He demonstrated these tendencies when he was a prosecutor in the Independent Counsel investigation of President Clinton and participated in a cover-up of the murder of Clinton’s Deputy White House Counsel Vincent Foster. Kavanaugh concluded that Foster drove himself to Fort Marcy Park outside of Washington, D.C., and shot himself, even though his car was not at the park at the time and his fingerprints were not on the gun. Kavanaugh replaced a prosecutor who quit rather than engage in the cover-up. That prosecutor said Kavanaugh was determined to “move up the ladder.”

Now Kavanaugh is poised to move up to the highest rung on the judicial ladder. This is the way Washington works. But President Trump promised to drain the swamp and give us pro-life judges who would overturn Roe. Let us hope and pray, therefore, that he reconsiders his nomination of Kavanaugh.
